There was a letter from the Chief Technology Officer, ICANN, to the 
Appointed Receiver:

The letter is publicly available on the organization's web 
site.  From what I understand, I could be wrong, ICANN acknowledges 
the receipt of a letter which it receives.  It then publishes the 
letter on its website and the processes it internally.

An apparent difference between what is said or promised and what 
happens or is true is known as a "credibility gap".  An organization 
could claim that it is open.  Anyone on the internet can see whether 
that is true or not.
